Dear Reader,

Today is the first Sunday of the month and so I will be analysing legislation. I will analyse a resolution passed by the Kerala State Legislative Assembly.

The resolution is against the three farm laws passed by the Central Government.

Resolution Against the Farm Laws of the Centre

The resolution says that the farmers genuine concerns should be addressed and the Centre should revoke the three laws.

In order to analyse this resolution we must first understand the aforementioned laws.

The three laws are

(i) THE ESSENTIAL COMMODITIES (AMENDMENT) ACT, 2020

(ii) THE FARMERS (EMPOWERMENT AND PROTECTION) AGREEMENT ON PRICE ASSURANCE AND FARM SERVICES ACT, 2020

(iii) THE FARMERS’ PRODUCE TRADE AND COMMERCE (PROMOTION AND FACILITATION) ACT, 2020

(i) The Essential Commodities (Amendment) Act, 2020 empowers the government to make regulations regarding the stocking and sale of certain food stuffs. This resolution does not relate to this law so I will not write about it.

(ii)The Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020 allows the farmer to enter into an agreement for the supply of farm produce and farm services.

This law allows the farmer to be free to make agreements relating to his business. Rightists advocates for individuals to be free to make their own business agreements. Therefore this is a Right-wing Act.

This law prevents any State Act from being applied to such an agreement so as to regulate the sale and purchase of farm produce. Libertarianism advocates for the government having less control over business agreements between citizens. Therefore this is a Libertarian Act.

For the same reasons, the Act is not a Left-wing or Authoritarian Act.

Therefore this is a Libertarian, Right-wing Act.

(iii) The Farmers’ Produce Trade and Commerce ( Promotion and Felicitation) Act, 2020.

This Act allows barrier free inter-State and intra-State trade and commerce of farmers’ produce.

This is a Libertarian, right wing Act.

Resolution:

The resolution is against these laws and seeks their repeal. It wants the old system of farmer’s being regulated by Agriculture Produce Marketing Committee (APMC) in the sale and purchase of farmer’s produce and services.

In this system the state controls the business activities of farmers. Therefore it is an Authoritarian system.

This system was made to make sure that the farmers are not free to make business agreements and decisions. Therefore it is a Left-wing system.

Therefore the previous system was an Authoritarian and Left-wing system.

This resolution supports that system. Therefore the resolution is also a Authoritarian and Leftist.

My Analysis:

I am a right-wing Libertarian and so I disagree with this resolution. I believe that these three laws are reforms for agriculture and are good. Therefore I believe that they should not be repealed.

This is an Authoritarian, Left-wing system.
